Dass schon bald der Vater, Odoardo Galotti, in Haftung genommen wurde, liegt, so die These, nicht zuletzt an einer Umwidmung oder Neukonzeption des tragischen Opfers. Es wird mit zentralen Versatzstücken der zeitgenössischen Geschlechtersemantik aufgeladen und einer metadramaturgischen Reflexion unterzogen. Emilias Selbstopfer ist ein Opfer im (...) Wortsinn, es stattet die victima mit allen Attributen des sacrificiums aus. Und es ist ein Opfer, das maßgeblich von der Figur selbst in die Wege geleitet und vollzogen wird. Even today numerous misreadings occur. Voices which criticized its questionable or yet dubious construction soon faded. Instead of that, responsibles have been searched for. Especially Odoardo Galotti, Emilia’s father, has been taken into accountability. The reason for this, thus the claim, lies in a new conception of tragic sacrifice. It is being charged with central elements of contemporary gender anthropology. Furthermore, it undergoes a metadramaturgic reflection. Emilia’s self-sacrifice represents a genuine »Opfer« in the literal senses of victima and sacrificium. Actually, this sacrifice is significantly initiated and performed by the character itself. A major part of subsequent dramatic production is adopting the tragedy’s premises on gender anthropology while commenting on the fulminant ending. It is as early as this that a bourgeois culture of dignity is being undermined by a victimhood culture. The drama does in fact document a crisis of tragedy itself. If already sacrifice possesses a dimension of representation, a further question remains yet unanswered: Which function does representation of sacrifice fulfill? (shrink)

It thus deals with the question, how literarily open objects act. According to Luhmann and Latour, action can be connected to concepts of description: Be it that communication is reduced to action and only thus attributable to an agent, or that symbolic reference, (...) attribution and recording account for significant strands in human and non-human contexts of action. Simmel's Sociology explores elementary processes of socialization or collectivization. Thus, the sociology of the senses examines how sight, hearing, feeling, smelling and tasting contributes to constituting societies. Though Simmel observes that modern refined civilization diminishes the depths of the senses but increases its emphasis or enhancement with lust or aversion, the conclusion cannot be avoided that the artifacts and technologies of hearing have to be examined. Accordingly, this article can be regarded as a case study in the wake of Simmel: (...) In a time which it is not amiss to term “the Dark Ages of logic”, Karl Christian Friedrich Krause stayed not only true to logic but actually did something for its advancement. Besides making systematic use of Venn-diagrams long before Venn, Krause — once more taking his inspiration from Leibniz — propounded what appears to be the first completely symbolic systematic representation of logical forms, strongly suggestive of the powerful symbolic languages that have become the mainstay of logic since the (...) beginning of the 20th century. However, Krause’s limits in logic are also clearly visible: Krause’s method in logic is, in the main, not axiomatic; it is combinatorial. More importantly, Krause remained entirely within the confines of traditional syllogistics, neglecting propositional logic and, of course, first-order relational terms. (shrink)

We present a new road map for research on “How the Brain Got Language” that adopts an EvoDevoSocio perspective and highlights comparative neuroprimatology – the comparative study of brain, behavior and communication in extant monkeys and great apes – as providing a key grounding for hypotheses on the last common ancestor of humans and monkeys and chimpanzees and the processes which guided the evolution LCA-m → LCA-c → protohumans → H. sapiens. Animals depleting one patch of resources must decide when to leave and switch to a fresh patch. Foraging theory has predicted various decision mechanisms; which is best depends on environmental variation in patch quality. Previously we tested whether these mechanisms underlie human decision making when foraging for external resources; here we test whether humans behave similarly in a cognitive task seeking internally generated solutions. Subjects searched for meaningful words made from random letter sequences, and as their success rate declined, they (...) could opt to switch to a fresh sequence. As in the external foraging context, time since the previous success and the interval preceding it had a major influence on when subjects switched. Subjects also used the commonness of sequence letters as a proximal cue to patch quality that influenced when to switch. Contrary to optimality predictions, switching decisions were independent of whether sequences differed little or widely in quality. (shrink)

This article considers the proportionality requirement of the self-defense justification. It first lays bare the assumptions and the logic—and often illogic—underlying very strict accounts of the proportionality requirement. It argues that accounts that try to rule out lethal self-defense against threats to property or against threats of minor assault by an appeal to the supreme value of life have counter-intuitive implications and are untenable. Furthermore, it provides arguments demonstrating that there is not necessarily a right not to be killed in (...) defense against theft or minor assaults. While there is a general moral right of self-defense and a general right to life, the scope of these rights depends on certain social facts that—even within a liberal framework—can differ from one society to another. Moreover, the proportionality of self-defense does not depend on the rights of the aggressor alone, but also on a precautionary rule, shaped by the balance of interests of the society in question and aimed at protecting innocent people and other social interests. This rule can protect an aggressor even in cases where he does not have the right to such protection. (shrink)

Arguing against the doctrine of double effect, Bennett claims that the terror bomber only intends to make his victims appear dead. An obvious reply is that he intends to make them appear dead by killing them. I argue that the alleged refutations of this reply rest on a mistaken test question to determine what an agent intends, as Bennett's own test question confirms, and that Bennett is misled by confusing metaphorical death and literal death. Moreover, Bennett's argument is half-hearted anyway, (...) and going the whole way would not only undermine the DDE but also Quinn's revision of it. (shrink)

This paper seeks to clarify the process of ethical review primarily through a consideration of the lay member's role; it considers some of the conventional accounts of the role and portrays weaknesses in them. Its positive account places the ethical review service in a wide political context allowing the definition of lay member as a politically-positioned individual in the REC with the function of formally representing the public standards of morality in the medical research context.

A recent publication project entitled Asian Business Discourse has brought to the attention of the international readership an original body of research on business discursive practices and organizational communication issues in a variety of Asian cultures. In this Forum, we discuss some of the topics highlighted by the project, which arise from the recent indigenous research in business discourse as a multidisciplinary field.

BackgroundResuscitation and treatment of critically ill newborn infants is associated with relatively high mortality, morbidity and cost. Guidelines relating to resuscitation have traditionally focused on the best interests of infants. There are, however, limited resources available in the neonatal intensive care unit, meaning that difficult decisions sometimes need to be made. This study explores the intuitions of lay people regarding resource allocation decisions in the NICU.MethodsThe study design was a cross-sectional quantitative survey, consisting of 20 hypothetical rationing scenarios. There were (...) 119 respondents who entered the questionnaire, and 109 who completed it. The respondents were adult US and Indian participants of the online crowdsourcing platform Mechanical Turk. Respondents were asked to decide which of two infants to treat in a situation of scarce resources. Demographic characteristics, personality traits and political views were recorded. Respondents were also asked to respond to a widely cited thought experiment involving rationing.ResultsThe majority of respondents, in all except one scenario, chose the utilitarian option of directing treatment to the infant with the higher chance of survival, higher life expectancy, less severe disability, and less expensive treatment. As discrepancy between outcomes decreased, however, there was a statistically significant increase in egalitarian responses and decrease in utilitarian responses in scenarios involving chance of survival, life expectancy, and cost of treatment. In the classic ‘lifeboat’ scenario, all but two respondents were utilitarian.ConclusionsThis survey suggests that in situations of scarcity and equal clinical need, non-health professionals support rationing of life-saving treatment based on probability of survival, duration of survival, cost of treatment or quality of life. However, where the difference in prognosis or cost is very small, non-health professionals preferred to give infants an equal chance of receiving treatment. (shrink)

BackgroundEuthanasia is performed on occasion, even on newborns, but is highly controversial, and it is prohibited by law and condemned by medical ethics in most countries.AimTo characterise and compare the judgments of lay persons, nurses, and physicians of the acceptability of actively ending the life of a damaged newborn.MethodsConvenience samples of 237 lay persons, 214 nurses, and 76 physicians in the south of France rated the acceptability on a scale of 0–10 of giving a lethal injection in 54 scenarios composed (...) of all combinations of 4 within-subject factors: gestational age of 6,7, or 9 months; 3 levels of severity of either perinatal asphyxia or of genetic disease; attitude of the parents about prolonging care unknown, favourable, or unfavourable; and decision made individually by the physician or collectively by the medical team. Overall ratings were subjected to cluster analysis and each cluster to analysis of variance and graphic representation.ResultsLay persons (mean acceptability rating 4.29) were significantly more favourable to euthanasia than nurses (2.84), p<.005, or physicians (2.12), p<.005. Five clusters were found with different judgment rules, i.e., how the information was integrated. More physicians (30 per cent) than nurses (14 per cent), p<.01, or lay persons (11 percent), p<.01, rated euthanasia as never, under any condition, acceptable. Most, however, asserted that it was increasingly acceptable as the factors combined to favour it, especially when the parents desired to stop treatment. More physicians (45 per cent) and nurses (46 per cent) than lay persons (21 per cent), p<.01, used a complex conjunctive rule (level of parent’s attitude x level of severity of damage x consultation with team or not) rather than a simple additive rule.ConclusionsUnlike lawand medical ethics, most of the lay persons. nurses, and physicians judged the acceptability of euthanasia as a function of the circumstances. Most health professionals combined the factors in a conjunctive (multiplicative), rather than additive, fashion in accordance with legislation for adults in the Netherlands and elsewhere that requires a set of criteria to be fulfilled before it is legitimate to end apatient’s life. Responsibility and accountability of CEOs has been a major ethical concern over the past 10 years. Major ethical dilemmas at Enron, Worldcom, AIG, as well as other well-known organizations have been at least partially blamed on CEO malfeasance. Interviews with Ken Lay, CEO of Enron, after his 2006 fraud convictions provides an opportunity to document his perceived role in the demise of Enron. Possibly no other CEO has had as much impact on the scrutiny and legalization of business ethics as (...) Ken Lay. This analysis is timely because of many information sources now available and the recent Supreme Court decisions on Enron conviction appeals. Using Ken Lay as the focal point, a review of literature provides the background for research questions to explore the role of the CEO in developing an ethical corporate culture. (shrink)

Few works have had the impact on contemporary philosophy exerted by Hegel's Phenomenology of Spirit. Twentieth-century philosophers in France were bound together by a reading of Hyppolite's translation and commentary. Sartre, Merleau-Ponty, Lacan, and Bataille were all shaped by Kojève's lectures on the book. Late twentieth-century philosophers such as Derrida, Lyotard, Deleuze, and Irigaray all operate against a Hegelian horizon. Similarly, in Germany Heidegger, Adorno, and Habermas developed their philosophies in large part through an engagement with Hegel. In the United (...) States the book has had a profound influence on feminism and gender studies. Thinkers as diverse as Butler, Benhabib, Mills, and Honig have developed political theories as well as theories of sexual difference by rereading Hegel's reading of Antigone. As Derrida suggests, this text must be read. It lays out the infrastructures and architectures of life in the modern nation state. It unfolds a grand narrative of the ways of thinking and acting that comprise human experience in "our time." The purpose of the text is to effect a transformation in readers, so that they cease to think of themselves as particular humans and come to know that their existence inheres in membership in a complex community-social, cultural, economic, religious, aesthetic, and political infrastructures that form the culture of possibilities in which self-consciousness emerges and is sustained. Rawlinson's reading reveals how Hegel's politics of the "we" is undermined both by his effacement of sexual difference and by his misappropriation of art as a "betrayal of substance." Both of these gestures discount specificity in favor of a generic subject and a mutual recognition in which the other is the same. She uses Hegel's own critique of abstraction against him to rethink the "we" as a community of difference, figured materially in the differentiated styles or signatures of art, and in so doing argues that that the task of phenomenology is never completed and that the abstract concepts of logic will always be dependent on phenomenology's productive or generative movement. In her reading Hegel is neither a metaphysician nor a subjective idealist. He is a phenomenologist, analyzing experience to articulate the ways in which humans generate narratives and material infrastructures to sustain the complexities of life. (shrink)

Background: Lay persons’ judgements of the acceptability of the not uncommon practice of ending the life of a damaged neonate have not been studied. Methods: A convenience sample of 1635 lay people in France rated how acceptable it would be for a physician to end a neonate’s life—by withholding care, withdrawing care, or active euthanasia—in 54 scenarios in which the neonate was diagnosed either with perinatal asphyxia or a genetic abnormality. The scenarios were all combinations of four factors: three levels (...) of maturity or immaturity, three levels of severity of the health problem, three levels of parents’ preference concerning prolonging care and two levels of decision-making (with or without consulting the other caregivers). Analyses: Analyses of variance of the participants’ responses were performed to determine the importance of each factor; the interactions among factors, with methods of ending life and with other patient characteristics; and the differences between asphyxia and genetic abnormality. A cluster analysis was performed to look for groups with different patterns of responses. Results: Lay people assigned most importance to the parents’ request and to the severity of the problem. Except for a small group (12%) always opposed to ending life, they used a simple additive-type rule in integrating the information. Implications: Most of this sample of French lay people are not categorically for or against ending the life of a damaged neonate, but judge its degree of acceptability by adding up those factors that seem most salient to them. This article explores the responses to nihilism offered by Jean-Luc Marion and Martin Heidegger. In particular, this paper offers a response to Steven DeLay’s ‘The vanity of authenticity’; DeLay’s text argues for the superiority of Marion’s response to nihilism through his notion of vanity and, further, argues that this supposed defeat of Heidegger by Marion lays the foundation for the theological turn in philosophy. This paper will instead suggest that Marion has not in fact surpassed Heidegger, that his concept of (...) vanity does not represent a meaningful innovation, and that his answer to nihilism/vanity through love is more similar to Heidegger’s response than either DeLay or Marion acknowledges. DeLay’s reading focuses on Heidegger’s Being and Time, but uses this reading to dismiss Heidegger’s work in its entirety. This paper will, instead, focus on Heidegger’s later work, which is ignored by both Marion and DeLay, offering particular attention to the shift in Heidegger’s response to nihilism as he increases his engagement with the thought of Friedrich Nietzsche and introduces the concept Gelassenheit, which generally replaces the terminology of authenticity after the 1940s. Hobbes, Locke, and Confusion's Masterpiece: An Examination of Seventeenth-Century Political Philosophy. New York: Cambridge University Press, 2003. Pp. v + 281. Cloth, $65.00. Paper, $23.00. The title of Ross Harrison's book is taken from Macduff's line in Macbeth, "[c]onfusion now have made his masterpiece," in reference to the discovery of a murdered king. Regicide (...) was a particularly unsettling crime in the day of Shakespeare, as Harrison reminds us, since kings were often associated with divinity (2). And perhaps it was their obvious and fragile mortality, as witnessed by the killing of King Charles I, that served to further unsettle what had previously been taken for granted in the modern world—the very foundations of the state. Today, Jürgen Habermas informs us from the perspective of critical theory that we live in a "postmetaphysical condition," where we can no longer count on the apparatus of Christian natural law or Platonic Ideas to justify the state and its laws. Practically, the difficulty in Iraq of bringing together the various religious perspectives of Sunnis, Shiites, Kurds, Christians, and others suggests that different religions or even varying interpretations of the same religion provide formidable barriers to the foundation of political systems. How do we bring people of different worldviews and perspectives together into one state? The great virtue of Harrison's book is the reminder that this is not a new problem. Rather, it resides at the core of the greatest challenges for political philosophy in any age. This challenge inspires what Harrison calls "some of the greatest and most important political philosophy ever written" (1).Thomas Hobbes is the first to receive extensive attention. Harrison provides a careful step-by-step analysis of Hobbes's reasoning in Leviathan. His affection for Hobbes is thinly veiled, as he parenthetically refers to Leviathan as "the greatest work of the greatest political philosopher" (62). Much of his account is standard, as he skillfully walks the reader from Hobbes's fascination with science to the sweeping authority of the sovereign. What is particularly worthy of note is his attention to the matter of foundations in Hobbes. Here his characterization reminds us of the eternality of Hobbes's central problem: "... how in a sceptical age to make statements of human reason that can depend on something fixed, or generally agreed" (64). Having found God superfluous to the question, according to Harrison, Hobbes ultimately employs prudence in relation to self-interest to be this fixed object. Since prudence—particularly its response to threats of violence—is the one element shared by all peoples, regardless of their religious or moral commitments, it makes the most sturdy foundation of political reasoning.The second object of extended attention is John Locke. And as was the case with his treatment of Hobbes, Harrison again looks to the foundations. As most readers of Locke are aware, the law of nature plays a central role in his thought, and if one is to get to the foundations of his politics, then one must unravel its mysteries. Locke makes solving these mysteries difficult for readers by denying the existence of innate ideas in the Essay. Locke makes his own task of grounding his theory difficult by doing just the same—denying the existence of innate ideas. Grounding natural law is made even more troublesome by his apparent appeals to these very same innate ideas on two occasions in the Second Treatise (§11, §136). It is perhaps in his own confusion that, according to Harrison, he "falls back, [End Page 224] after all, on revelation" (180). This is particularly unsatisfactory for Harrison, since revelation is characterized by the indeterminacy that led to the political conflict between Protestants and Catholics in modern England and eventually to the works of Hobbes and Locke in the first place.Shorter chapters are devoted to Grotius, Pufendorf, and the less-celebrated sixteenth-century figure, John Ponet. The current work builds a definition of irritability from both academic definitions and lay perspectives. In Study 1, a quantitative content analysis of academic definitions resulted in eight main content categories. In Study 2, a community sample of 39 adults participated in qualitative interviews. A deductive thematic analysis resulted in two main themes. The first main theme dealt with how participants positioned irritability in relation to other negative states. The second dealt with how participants constructed irritability as both a loss (...) of control and as an experience that should be controlled. The discussion integrates the findings of both studies and provides a concise, but comprehensive definition. (shrink)

Process thought is the foundation for studies in many areas of contemporary philosophy, theology, political theory, educational theory, and the religion-science dialogue. The body of Christ is the focus of a range of questions posed to St. Thomas Aquinas by the audiences at the quodlibetal disputations over which he presided at the University of Paris. These questions arise from reflection on the Catholic faith, which holds that the body of Christ is given to us as spiritual food in the sacrament of the altar, the Eucharist. In response to questions about the Eucharist, Aquinas tries to explain how Christ’s body could come to (...) be present in the sacrament by the bread becoming Christ’s body, arguing that by God’s power the substance of Christ’s body can come to be present under the attributes of bread, which can continue to exist without being the attributes of anything. Yet why must this be the answer? Why can’t Christ’s body come to be present with the bread, for instance? Aquinas insists that the bread and Christ’s body never exist together, but he allows that Christ’s glorified body can be with another body in the same place. So, why not in the Eucharist? Or why can’t Christ assume the bread, as he assumed a human nature, thereby making it his body? It might seem unfitting for Christ to have such a non-rational nature, yet that is exactly what Aquinas thinks happened while Christ’s body lay in the tomb. So, why not in the Eucharist? This paper attempts to explain why not. Examining the full range of questions posed to Aquinas about the body of Christ reveals a number of principles that together seem to imply that nothing less than the full transubstantiation of bread into Christ’s body is possible if Christ’s body is to become really present in the Eucharist. Okasha claims at the outset of his book "Evolution and the Levels of Selection" that the Price equation lays bare the fundamentals underlying all selection phenomena. However, the thoroughness of his subsequent analysis of multi-level selection theories leads him to abandon his fundamentalist commitments. At critical points he invokes cost benefit analyses that sometimes favors the Price approach and sometimes the contextual approach, sometimes favors MLS1 and sometimes MLS2. And although he doesn’t acknowledge it, even the Price approach breaks down (...) into a family of alternative equations that parse the causes in different ways, none of which is uniquely correct and none of which achieves the ultimate isolation of effects due to what Okasha believes are the fundamental causes. I argue that his book provides good reason to re-conceive our understanding of evolutionary theorizing in terms of a toolbox view and to stop subjecting the analyses of evolutionary concepts to a universalist standard. Background: By organizing and activating our passions with both hormones and experiences, the heart and mind of sexual behavior, sexual motivation, and sexual preference is the brain, the organ of learning. Despite decades of progress, this incontrovertible truth is somehow lost in the far-too-often biologically deterministic interpretation of genetic, hormonal, and anatomical scientific research into the biological origins of sexual motivation. Simplistic and polarized arguments are used in the media by both sides of the seemingly endless debate over sexual orientation, (...) equality, and human rights with such catch phrases as ‘‘born gay’’ contrasted against attempts of ‘‘reparative therapy’’ or ‘‘pray the gay away’’. Though long abandoned in practically every other area of psychology, this remnant of the nature-nurture controversy remains despite its generally acknowledged insufficiency in explaining any adult aspect of the human condition within the scientific community. Methods: This theoretical review article identifies three factors: 1) good intentions with regard to the argument from immutability; 2) false dichotomies limiting intellectual progress by oversimplification of theory and thus hypothesis, and most dangerously, interpretation and; 3) Tradition: a historical separation of the disciplines of biology and psychology, which, to this day, interferes with the effective translation of well-conducted science into good public understanding and policy. Results: Studies clearly demonstrate that progress toward sexual-orientation equality is being made, if slowly, despite the apparent irrelevance of the ‘‘born gay’’ argument from immutability. Evidence is further provided supporting the inadequacy of polarized, dichotic theories of sexual development, particularly those pitting ‘‘blank slate learning’’ against a fated, deterministic biological perspective. Results of this review suggest that an emerging interactionist perspective will promote both better scientific progress and better public understanding, hopefully contributing to progress toward nondiscriminatory public policy. Conclusion: Accepting that the brain is a highly plastic, modularly dimorphic, developmentally biased organ of learning, one which is organized and activated by both hormones and experiences across the lifespan, is essential for doing ‘‘good science’’ well. Interactionist theories of psychosexual development provide an empirically sound, strong, yet modifiable foundation for testable hypotheses exploring biologically biased sexual learning. In answering the question, “How is the concept of a person possible?”, Strawson lays great stress upon a particular class of predicate.He says, “They are predicates, roughly, which involve doing something, which clearly imply intention or a state of mind or at least consciousness in general, and which indicate a characteristic pattern, or range of patterns, of bodily movement, while not indicating at all precisely any very definite sensation or experience …. Such predicates have the interesting characteristic of many P-predicates, (...) that one does not, in general, ascribe them to oneself on the strength of observation, whereas one does ascribe them to others on the strength of observations. But, in the case of these predicates, one feels minimal reluctance to concede that what is ascribed in these two different ways is the same. This is because of the marked dominance of a fairly definite pattern of bodily movement in what they describe, and the marked absence of any distinctive experience. (shrink)
